1. SCOPE

This user agreement sets out the terms and conditions of your use of our website and the goods/services provided through this site.

This user agreement is executed online by and between the Spanish law firm formed by Helena González Martínez (bar member No. 74.959 ICAM), Javier Muñoz Pereira (bar member No. 55209 ICAM) and Esther García Vaquero (bar member No. 63111 ICAM) (hereinafter, “iAbogado”), with registered office here.

And you on the other hand. By accesing our site or purchasing goods/services through this site you are entering a legal contract with iAbogado on these terms and conditions.

2. LEGAL GUIDE SECTION

Our Legal Guide is intended to supply accurate and current information, however, given that the law is subject to constant changes, we cannot guarantee it. We recommend you consult a lawyer before taking action regarding an individual’s specific circumstances, our website describes general legal principles, these are provided for information purposes only and do not constitute legal advice, therefore these should not be used as a substitute for advice from a qualified lawyer.

Information provided on our web site is not intended to be legal advice, but merely conveys general information related to legal issues and services commonly encountered.

3. FIXED PRICE LEGAL SERVICES

The fixed price legal services consist of legal services provided by our qualified Lawyers. In some specific cases, legal services may be rendered in cooperation with referral lawyers by virtue of an agreement of legal cooperation between iAbogado and the external lawyer. Referral Service will match you with lawyers who hold themselves out as practising in the legal area relevant to your circumstances.

By purchasing any service through this site, you are entering a legal contract with us on these terms and conditions. If you do not agree to these terms and conditions, or if you are under 18 years of age, do not use our site.

Prices and Payment. Payment for Fixed Price Legal Services must be made in advance in full. These payments can be made by PayPal or wire transfer. No legal services will be provided until we have received confirmation of payment. Our lawyer will contact you either by telephone or email within 2 working days from the receipt of the confirmation of payment.

iAbogado reserves the right to change at any moment the contents and price of legal services .

In those cases where the referral lawyer shall render the service purchased, he shall not request you additional fees. If you need additional services not included in the service purchased, you should contact iAbogado for more information and prices.

The referral lawyer shall act in accordance with the ethic rules and due diligence, respecting the privacy of our users and maintaining the profesional secrecy.

We expressly deny any liability and undertakes no responsibility for the results or consequences of any legal representation provided by any of the Refferal lawyers or law firms.

Cancellation of the service: Once this agreement has been concluded, you may cancel the contract in relation to fixed price legal service within 7 working days upon written notice to us through our contact page, and your payment will therefore be refundable within 15 working days, discounted the bank charges for the transfer and provided that the service had not been already rendered.

Fixed price legal services may not be available to you due to unusual or complex points of law that your particular facts or circumstances may reveal. If you have requested Fixed Price Legal Services but we determine, in our sole discretion, that the complexity of the facts or circumstances renders Fixed Price Legal Services inappropriate, we will advise you that such services cannot be provided and refund all monies paid for such services within 15 working days.

4. ‘ASK A LAWYER’ SECTION

The foregoing conditions set forth in section 3 of this agreement will be aplicable to this section in addition to some special features.

Cancellation of the service: Once the service is paid, you will have no right to cancel the service and your payment will therefore be non-refundable.

Once you submit your question, it will be reviewed by a duly qualified lawyer. By submitting your question, you understand that a lawyer/client relationship is not being established, the information provided by the lawyer merely conveys general information related to legal issues according to your consultation previously submitted.

5. INTELLECTUAL PROPERTY AND OWNERSHIP

iAbogado is the exclusive owner of the site iabogado.com and its URL www.iabogado.com. Any unauthorised use of any of these trade marks or trade names is prohibited.

iAbogado is the exclusive owner of this website and all copyright, database rights, patent rights and other intellectual property rights relating to this website and its content, documents, data, design, text, images, graphics, layout, functioning, software and source code. All rights relating to this website are reserved and protected according to the Spanish Intellectual Property Law and other Spanish and international laws in force reffering author rights.

All uses of this website (including your access to this site) and any contents of the site that are not expressly permitted are prohibited. These prohibited uses include any sale, licensing, rental, distribution of this site or your access to this site; and any publication, posting, framing, transmission, display, reverse engineering or modification of or creation of derivative works from this site.

6. EXCLUSION OF LIABILITY

iAbogado will not be liable to you for any indirect, consequential, special or incidental damage or loss arising from your use of or inability to use this website, including loss of business or profits or anticipated savings, loss or corruption of data, loss caused by a virus, loss of or damage to property, claims of third parties, fines or penalties levied by any taxing or other authority or any other loss or damage.

Information. iAbogado SLU accepts no responsibility for any information that you provide (including any inaccuracies therein) or any failure by you to provide all information required in connection with your request for legal Services. Information provided on our website is not intended to be legal advice, but merely conveys general information related to legal issues and services commonly encountered.

Errors and corrections. Provider does not represent or warrant that the Web Site will be error-free, free of viruses or other harmful components, or that defects will be corrected. Provider does not warrant or represent that the information available on or through the Web Site will be correct, accurate, timely, or otherwise reliable. Provider may make improvements and/or changes to its features, functionality or content of the Web Site at any time.

Refferal Lawyers. We expressly deny any liability and undertake no responsibility for the results or consequences of any legal representation provided by any of the Refferal lawyers or law firms.

Data Protection. Your use of this Web Site is also subject to our Privacy Policy.

Suspension or termination. Operation of this website may be suspended from time to time, whether for maintenance or repairs or other reasons. We may also terminate your access to this website at any time upon notice to you by email or by withdrawing this website, in which case this Agreement will terminate and any services you have purchased but not received as of the date of termination will be provided or, at our option, any monies paid in respect of such services refunded.

Change of the Terms and Conditions. Provider reserves the right to change these Terms and Conditions of Use at any time. Updated versions of the Terms and Conditions of Use will appear on this Web Site and are effective immediately. You are responsible for regularly reviewing the Terms and Conditions of Use. Continued use of the Web Site after any such changes constitutes your consent to such changes.

7. OTHER DISCLAIMERS

Any individual or entity may include hyperlinks to our website, either to the homepage or any section of this website, provided that they do not remove or obscure, by framing or otherwise, advertisements, the copyright notice, or other notices on the Web Site, and that you give us notice of such link.

Complaints in respect of Fixed Price Services rendered by a Referral Lawyer should be sent directly to the Referral Lawyer providing the services, at the address for the lawyer provided.

9. DATA PROTECTION

9.1. Compliance with data protection regulations.

iAbogado SL complies with the principles of the Data Protection Law 15/1999, December 13th, (Ley Orgánica 15/1999, de 13 de diciembre, de Protección de Datos de Carácter Personal) and the rest of Data Protection legislation, when dealing with all data received from clients. We will ensure that Clients personal information is stored securely and we will not provide your personal information to any third parties, except to one or more Referral Solicitors in order to provide the services under this Agreement. By agreeing to this Policy, Clients are consenting to the following:

(a) We or parties acting on our behalf must store, host, transfer and otherwise process Client information in order to refer Clients request to a Referral Solicitor. Clients explicitly consent to us handling their personal information, which Clients have provided for delivery to one or more Referral Solicitors. We shall do our best to ensure that the Referral Solicitors also take adequate security measures in relation to Clients information.

(b) Some of the personal information that client supply might include sensitive information, including matter relating to Clients religious beliefs, sexual preferences, union or other memberships, political beliefs or affiliations and similar matters. Client explicitly consent to the processing and/or handling by us and/or any Referral Solicitors for the purposes of this Policy of all sensitive information supplied by clients.

Clients may request access to all their personally identifiable information that we collect online and maintain in our database, according to the Data Protection Law 15/1999, December 13th, by contacting iAbogado S.L.

All data received is registered in the Spanish Data Protection Agency general registry (Registro General de la Agencia española de Protección de Datos) (www.agenciaprotecciondatos.org) where anyone can access to check such data.

9.2. Data Security.

To prevent unauthorized access to Clients personal information and bad use, alteration or removal of data received from Clients, maintain data accuracy, and ensure the correct use of information, iAbogado SLU has put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we collect online, including SSL security for credit card submissions; To protect the security of the information Clients give us when they order online, iAbogado.com uses Secure Sockets Layer (SSL) technology. SSL encrypts information so that no one other than iAbogado.com will be able to decode it. SSL establishes a secure connection between your computer and our computers, and that connection remains secure until you complete or cancel an order.

Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. Accordingly, despite our efforts to protect clients personal information, iAbogado.com cannot ensure or warrant the security of any information Clients transmit to us, or to or from our online services. Clients transmit all such information at their own risk. However, once we receive Clients transmission, we make our best effort to ensure its security on our systems.

9.3. Professional secrecy.

Private communications between Clients and each referral attorney through iAbogado.com are confidential. Access to this information is restricted with encryption and authentication tools to protect information we gather on our Web site.

Only users and the Referral Solicitor can access to the messages content. iAbogado.com technicalservices have only access to contact information and to the hour and date of each communication, but no to the messages text content.

For security reasons, iAbogado.com may delete after 90 days of its use personal client data.

IAbogado.com encourages Clients not to share to third parties identifications, passwords or reference numbers we have provided them.

9.4. Unauthorized access protection.

Clients’ personal information sited inside iAbogado.com servers is as safest as possible. We use encryption and authentication tools to protect information we gather on our Web site. E-mail communications outside of our Web site, however, may not be protected. If Clients are sending us an e-mail communication which includes highly confidential information, such as a credit card number, you may want to call us or send it by regular mail.

Also iAbogado.com uses a firewall to control an outsider access to the servers.

9.5. Log files.

iAbogado.com can use IP addresses to analyse trends, administer the site, track user´s movement, and gather broad demographic information for aggregate use. This information may be used to troubleshoot server problems or to analyseweb traffic to ensure that the web site is configured to provide users with optimal browsing experience. No other use is made of this information and there are no specifics about users´ identities in the log files. IP addresses are not linked to personally identifiable information

9.6. Collection of information by Third-Party Sites.

Any personal information collected about users will not be sold or transferred to third parties without the express consent of those users at the time the information is solicited. iAbogado.com may disclose personal information when we believe in good faith that the law requires it or to protect the rights or property of iAbogado.com. However:

* Transfer of data is necessary in credit card operations and banking transactions. Payment information is obtained only for billing the client and is not shared with anyone outside iAbogado.com, except the merchant bank for the processing of credit card orders. In order to provide such service to clients, it is necessary for us to share clients personal information with the bank. And no one inside iAbogado.com can access to the clients credit card data.

* iAbogado.com may provide to third parties statistics about number of visits, average time spent or page views, but they will not include any personal information that identifies Clients, unless Clients have agreed to receive personally-tailored information

9.7. Links to other Web sites and services.

To the extent that this Web site contain links to outside services and resources, iAbogado.com does not control the availability and content of those outside services and resources. Any concerns regarding any such service or resource, or any link, should be directed to the particular service or resource.

9.8. Email communications to Clients.

Occasionally, iAbogado.com may send e-mail communications to Clients with information that may be useful to them. To protect privacy of Clients they have absolute control of the incoming email messages. So Clients will be given the option of not receiving such e-mail messages, if they choose.

The different kind of communications a Client may periodically receive are as follows:

* Site and services updates: We send every Client a welcome message to verify password or user ID. We also send them site and services update e-mails. Clients will not be given the option of not receiving these e-mail messages, because they have important information about iAbogado.com.

* iAbogado.com may also contact Client by e-mail or phone to resolve doubts due to any hired legal service.

* Special offers: Occasionally Clients may receive information about products and services, special offers and newswires. Clients will be given the option of not receiving any such e-mail messages, if they choose.

* Correcting/updating personal information: If the Client registry information is wrong or has changed, it can be modified by clicking the corresponding “modify” button.

If a user no longer desires our service, he/she can cancel the subscription upon request.

9.9. Cookies.

“Cookies” give users a special, random ID that are small text files, which are stored on the hard drive of a user’s computer. iAbogado.com does not employ cookies at all.

10. LAW AND JURISDICTION

Your use of this site and its contents will be governed and construed in accordance with the laws of Spain.

These terms and conditions on this site constitute the entire agreement with respect to your access to and use of this site. If these terms, conditions, and provisions are not acceptable to you in full, you must immediately terminate your use of this site.
